Clean The Cans Terms & Conditions

These Terms and Conditions govern services provided by Clean The Can LLC, doing business as Clean The Cans (“Clean The Cans,” “we,” “us,” or “our”).
By purchasing, scheduling, or receiving services from Clean The Cans, the customer (“customer,” “you,” or “your”) agrees to these Terms and Conditions.
1. Service Plans
Clean The Cans offers the following service plans:
- Monthly Cleaning: Recurring cleaning approximately once per month.
- Quarterly Cleaning: Recurring cleaning approximately once every three months.
- One-Time Cleaning: A single cleaning without a recurring-service commitment.
The exact service frequency, number of cans, price, and applicable promotions will be displayed at checkout or otherwise communicated when service is ordered.
Service dates may vary because of trash-collection schedules, holidays, weather, equipment issues, staffing, route changes, or circumstances outside our reasonable control.
2. Recurring-Service Commitment
Monthly and quarterly plans are offered at discounted recurring-service rates in exchange for a minimum number of paid cleaning visits:
- Monthly plans require a minimum of 12 paid cleaning visits.
- Quarterly plans require a minimum of 4 paid cleaning visits.
- One-time cleanings do not renew and do not require a minimum commitment.
The commitment is based on the number of completed and paid cleaning visits, not solely on the number of months that have passed since enrollment.
A rescheduled visit does not restart or extend the customer’s commitment. An unsuccessful visit for which only a $15 unsuccessful-visit fee is charged does not count as a completed cleaning visit.
3. Pricing
Customers will be charged the price displayed and accepted at checkout or otherwise agreed upon when service is ordered.
Pricing may depend on:
- The selected service plan;
- The number and size of cans;
- The service location;
- Available promotions;
- Additional requested services; and
- Other factors disclosed when service is ordered.
Promotional pricing may be subject to eligibility requirements, minimum commitments, or other conditions disclosed with the promotion.
Clean The Cans may change pricing for future services after providing reasonable notice. A change in pricing will not change amounts already owed for services previously performed.
4. Automatic Payments
By enrolling in service, the customer authorizes Clean The Cans and its payment processor to store the customer’s payment information and automatically charge the selected payment method for:
- Scheduled and completed cleaning services;
- Applicable taxes;
- Approved additional services;
- Past-due account balances;
- Applicable late fees and interest;
- Applicable unsuccessful-visit fees;
- First-cleaning early-cancellation adjustments; and
- Other amounts authorized under these Terms.
Recurring billing cycles generally begin on the customer’s original signup date. The billing date and actual service date may differ.
The customer is responsible for providing accurate billing information and maintaining a valid payment method.
Clean The Cans may update stored payment information through account-updater services offered by its payment processor or the customer’s card provider where permitted.
5. Failed Payments, Late Fees, and Interest
If a payment fails, Clean The Cans may contact the customer by telephone, text message, or email. Clean The Cans may continue attempting to collect the amount owed using an authorized payment method on file.
If a balance remains unpaid for seven calendar days after the first failed-payment notice, a $15 late fee may be added. Only one $15 late fee will be charged for each overdue billing cycle.
Any principal balance remaining unpaid for 30 calendar days after its original due date may accrue simple interest at a rate of 1% per month, equivalent to 12% per year.
Interest will:
- Be calculated only on the unpaid principal balance;
- Not be charged on late fees or previously accrued interest;
- Not be compounded; and
- Stop accruing when the applicable principal balance is paid.
If applicable law permits a lower fee or interest rate, the charge will be limited to the maximum amount permitted by law.
Clean The Cans may pause or postpone service until the balance is paid and valid payment information is provided. Pausing service for nonpayment does not automatically cancel the customer’s recurring plan or eliminate an outstanding balance.
6. Cancellation
Customers may cancel their service at any time. However, if a cancellation request is received on the same day the cleaning is scheduled, the customer may still be charged for that day’s service if it has already been scheduled or routed. To avoid any charge, please cancel before the day of service.
Cancellation requests may be submitted:
- Through any online cancellation option provided in the customer’s account;
- By email at support@cleanthecans.com; or
- By telephone at (208) 216-1166.
If the customer enrolled online, Clean The Cans will provide a free online method of cancellation as required by applicable law. Customers may also cancel using the same general method they used to enroll when required by law.
Stopping payment, disputing a valid charge, removing a payment method, or refusing a scheduled cleaning does not by itself cancel a recurring plan.
A cancellation becomes effective when Clean The Cans receives and processes the request. Clean The Cans will not charge the customer for future cleaning visits occurring after the effective cancellation date, except for amounts already owed under these Terms.
Nothing in these Terms limits any cancellation right that cannot legally be waived, including any applicable right to cancel certain door-to-door sales.
7. Early Cancellation Adjustment
Monthly and quarterly plans are offered at discounted recurring-service rates.
If a customer cancels before completing the required number of paid cleaning visits, only the customer’s first cleaning is subject to an early-cancellation price adjustment.
The adjustment will equal the difference between:
- The discounted amount the customer paid for the first cleaning; and
- The one-time cleaning price that would have applied to that first cleaning based on the number of cans cleaned and the pricing in effect when the customer enrolled.
Only the first cleaning will be repriced. Subsequent completed cleaning visits will remain charged at the recurring-service prices originally paid and will not be retroactively repriced at the one-time rate.
For example, if a customer paid $18.75 for the first cleaning but the applicable one-time price for that cleaning would have been $46.80, the early-cancellation adjustment would be $28.05.
Customers will not be charged for future cleaning visits that were never performed.
The customer authorizes Clean The Cans to charge the first-cleaning adjustment to the authorized payment method on file after an early cancellation.
8. Service Scheduling
Cleaning appointments are generally scheduled around the customer’s regular trash-collection day. Service dates, arrival times, and service windows are estimates and are not guaranteed.
Clean The Cans may reschedule or delay service because of:
- Changes to trash-collection schedules;
- Holidays;
- Severe weather or unsafe temperatures;
- Unsafe driving or working conditions;
- Equipment or vehicle problems;
- Staffing or route changes;
- Road closures;
- Government restrictions; or
- Other circumstances outside our reasonable control.
When practical, Clean The Cans will notify customers of significant scheduling changes.
A delayed or rescheduled visit will not be considered a failure to provide service when Clean The Cans completes the visit within a reasonable period or offers another reasonable resolution.
9. Customer Responsibilities and Access
Customers must ensure that their cans are:
- At the agreed service location;
- Available during the service window;
- Reasonably accessible to our technicians;
- Not locked behind an inaccessible gate;
- Not excessively full or heavy;
- Free of hazardous or prohibited materials;
- Structurally safe to handle and clean; and
- In a condition that can be serviced safely.
Customers are responsible for securing pets and providing a safe path to the cans.
Unless the customer instructs us otherwise, an unlocked gate or accessible area where the cans are ordinarily stored may be treated as permission for our technician to enter that limited area solely to locate, retrieve, clean, and return the cans.
Clean The Cans will make reasonable efforts to locate cans, but customers remain responsible for making the cans reasonably available.
10. Inaccessible, Full, Missing, or Unsafe Cans
Customers should notify Clean The Cans before their scheduled service if their cans will be unavailable, inaccessible, excessively full, or otherwise unable to be cleaned.
If the customer contacts Clean The Cans before our technician travels to the customer’s area, we will reschedule the cleaning without charging an unsuccessful-visit fee.
If our technician has already traveled to the customer’s area and the cleaning cannot be completed because the cans are unavailable, inaccessible, excessively full, unsafe, or not ready for service, a $15 unsuccessful-visit fee may be charged to help cover technician time, travel, and route costs.
The $15 unsuccessful-visit fee does not count as a completed cleaning toward the customer’s minimum service commitment.
Clean The Cans may refund or credit the $15 fee when the customer promptly contacts us and provides a valid or reasonable explanation for being unable to give advance notice. Examples may include:
- An unexpected trash-collection delay;
- A medical or family emergency;
- Illness;
- Severe weather;
- An unexpected access problem; or
- Another circumstance reasonably outside the customer’s control.
Refunds and credits will be evaluated reasonably and in good faith based on the circumstances.
Clean The Cans will work with the customer to reschedule a missed cleaning. However, we may decline or postpone service until an unsafe or prohibited condition is corrected.
11. Cleaning Limitations and Prohibited Materials
Clean The Cans aims to remove normal dirt, residue, odors, and buildup. Some staining, discoloration, embedded material, damage, or odors may not be completely removable.
Clean The Cans may refuse to clean cans containing or contaminated by materials that could create a health, safety, environmental, or equipment risk, including:
- Hazardous chemicals;
- Paint, solvents, oils, or fuels;
- Medical or biological waste;
- Human or animal waste not properly contained;
- Hot ashes or burning material;
- Excessively heavy construction debris;
- Sharp objects that are not safely contained; or
- Any other material our technician reasonably considers unsafe.
Clean The Cans is not responsible for preexisting damage, ordinary wear, fading, staining, cracking, weakened plastic, broken lids or wheels, or defects caused by the can’s age or condition.
The customer is responsible for disclosing any known condition that could make a can unsafe to move or clean.
12. Service Concerns, Re-Cleanings, Credits, and Refunds
If a customer is dissatisfied with a cleaning, the customer should contact Clean The Cans promptly and provide a reasonable opportunity for us to investigate and correct the issue.
Depending on the circumstances, Clean The Cans may:
- Return and re-clean the can at no additional charge;
- Reschedule the service;
- Issue an account credit;
- Refund an applicable charge; or
- Provide another reasonable resolution.
The appropriate resolution will depend on the specific circumstances.
Refunds are not guaranteed when service could not be completed because the customer failed to provide access, failed to make the cans available, or did not satisfy the service requirements described in these Terms.
Any refund will generally be issued to the original payment method.
13. Service Photographs
Technicians may take photographs of cans and their immediate surroundings before or after service to:
- Confirm that service was performed;
- Document the condition of the cans;
- Show where the cans were returned;
- Document inaccessible, missing, full, or unsafe cans;
- Address customer-service questions;
- Verify the number of cans serviced; or
- Maintain internal service records.
Customers may request copies of applicable service photographs.
Clean The Cans will not intentionally photograph private areas unrelated to providing, verifying, or documenting the service.
Unless the customer separately gives permission, customer-specific service photographs will not be used publicly in a way that identifies the customer or their address.
14. Communications
By providing a telephone number or email address, the customer authorizes Clean The Cans to send communications related to:
- Appointment reminders;
- Route and scheduling changes;
- Technician arrival or service updates;
- Completed services;
- Service photographs;
- Billing and failed payments;
- Past-due balances;
- Account administration;
- Customer-service matters; and
- Other information reasonably related to the customer’s service.
Messages may be sent using automated systems where permitted by law. Message and data rates may apply.
Consent to receive promotional or marketing text messages is not a condition of purchasing service.
Customers may opt out of promotional text messages by replying STOP. Opting out of promotional messages does not prevent Clean The Cans from sending nonmarketing communications reasonably necessary to administer an active account where permitted by law.
15. Damage and Liability
Customers must notify Clean The Cans promptly if they believe our services caused damage to a can or other property.
Clean The Cans must be given a reasonable opportunity to inspect the alleged damage before repairs or replacement are arranged.
To the extent permitted by law, Clean The Cans is not responsible for:
- Preexisting damage or defects;
- Normal wear and tear;
- Damage caused by deteriorated or weakened cans;
- Damage caused by prohibited or undisclosed contents;
- Losses resulting from inaccurate customer information;
- Delays caused by circumstances outside our reasonable control; or
- Indirect, incidental, or consequential damages.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
16. Disputes and Chargebacks
Customers should contact Clean The Cans before initiating a payment dispute or chargeback so that we have a reasonable opportunity to investigate and resolve the concern.
Initiating a chargeback does not cancel recurring service. Customers must separately submit a cancellation request under Section 6.
Clean The Cans may provide the customer’s service records, communications, photographs, payment authorization, and acceptance of these Terms to the payment processor or card issuer when responding to a chargeback.
This section does not limit any lawful right the customer has to dispute an unauthorized or incorrect charge.
17. Changes to These Terms
Clean The Cans may update these Terms periodically.
Material changes affecting an existing recurring plan will be communicated by email, text message, account notification, website notice, or another reasonable method before the changes take effect.
Updated Terms will apply prospectively. Changes will not retroactively increase amounts owed for services already performed.
Continued use of the service after an updated version becomes effective constitutes acceptance of the updated Terms to the extent permitted by law.
18. General Terms
Customers are responsible for providing accurate contact information, service-address information, trash-collection information, access instructions, and payment information.
These Terms, together with the customer’s order and any written promotion or service-specific disclosure, constitute the agreement between the customer and Clean The Cans concerning the purchased service.
If a provision of these Terms is found invalid or unenforceable, the remaining provisions will remain effective.
A delay or failure by Clean The Cans to enforce a provision does not waive its right to enforce that provision later.
These Terms are governed by the laws of the State of Idaho, without limiting any consumer protection that must apply under another jurisdiction’s law.
Nothing in these Terms waives a legal right or remedy that cannot lawfully be waived.
